Fire Safety Act 2021 Summary

The Fire Safety Act 2021 was promulgated on April 29, 2021, and was introduced in Parliament in March 2020. It is an important piece of legislation for organizations with potentially significant deficiencies. According to the Regulatory Reform (Fire Safety) Order (RRO) of 2005, these deficiencies are regarded as “responsible persons” in the fire safety act. The said fire safety law should enforce this Fire Safety Law at the end of this year (2021). It is another step toward strengthening the fire safety system of transnational residential buildings.

Purpose of the Fire Safety Act 2021

The main focus of this law is on RRO modification, which is to clarify that it will apply to the main structure, including outer walls and any common parts (also all doors between local buildings and common parts) in any building that contains two or more seats in the home building. Concerning the outer wall, these walls include doors and windows and anything related to the outer part of the walls, including cladding and balconies.

This interpretation was considered necessary because it was not previously clear. The fire safety law covered the structure and outer walls of buildings. It also imposed responsibility for potentially dangerous external wall systems and structural issues in residential buildings on the owner.

The Fire Safety law also modified RRO to introduce what might be called “risk-based compliance.” It effectively demonstrates that when the responsible person is alleged to have violated RRO, proof of compliance with any risk-based guidance by that responsible person can be relied upon as no such violation has occurred. The conversation also applies to Anufer because failure to comply with established risk-based guidelines is such a violation. It does not provide legal defense but provides a useful standard for the responsible person who, if complied with, will bring reassurance with him. The government has not yet issued risk-based guidelines.

Impact Assessment

The law’s introduction means that RRO officials must ensure that a comprehensive fire risk assessment and fire safety strategy includes the building structure and exterior wall system.  , Which includes doors, windows, and balconies. Referring to the tragedy in Greenfield Tower and these issues, one expected to be widespread in any case, but the law includes the surrender and responsibility of the responsible person. There are issues related to the slope on a large scale.

In practical terms, this means that once the law enters into force, the authority shall grant these buildings’ owners and administrative agents. The owner shall occupy the building safely. It may include temporary safety measures, such as entering a waking hour until treatment is complete.

Under the Housing Act 2004, local authorities already have duties and rights regarding fire hazards in all these buildings. However,  we expect that regulators shall ensure the implementation of the amended Fire Safety Act to protect from fire.

Cost of Remediation

During the parliamentary debate on the Act, some MPs sought to introduce an amendment. The leaseholders shall not bear the cost of cladding treatment because of these amendments.

However, these MPs failed, and the current situation is that leases bear the cost of treatable work where the lease allows the landlord to approve these costs. The government is planning for a long-term, low-interest loan scheme for 11-meter and 18-meter-long buildings, potentially limiting leaseholders’ liability to £ 50 per month. In short

The law places additional responsibilities on the responsible person for multi-occupancy residential buildings. Those responsible people now have a legal duty to identify fire safety-related dangerous substances. Therefore, the authorities must ensure that they are up-to-date with government guidance. They may contact fire safety experts to ensure the proper control measures if necessary.
